Development and operating plans


Operating plans are developed by municipalities to determine how the costs of any land development will be recovered from the developer of the project. This may include costs associated with preparing the land for construction and the layout of the public space, but the construction of utilities is also laid down in the municipality's operating plans.

Final advice on development plans


Dutch municipalities are individually responsible for drawing up their own development plans. This means that the design, content and elaboration of the exploitation plans can vary considerably. The legislation itself is also in a state of flux: from January 1, 2015, the planning costs of land development have also been laid down in the development plan. This makes it easier for municipal preparation costs and operating costs to be distributed among all landowners in the exploitation area.

The differences between development plans, just like the ongoing development of the Land Development Act, can lead to confusion among municipalities, landowners and project developers. Because exactly which costs can be recovered and how? How can a municipality determine which development plan is optimal for it? And how do initiators of local area development best deal with this?
